The European Convention on Human Rights (ECHR) plays an increasingly important role in the Italian legal system, imposing on national courts the obligation to interpret domestic law in accordance with the rights enshrined in the Convention. The provisions of the ECHR, as interpreted by the European Court of Human Rights (ECtHR), constitute interposed parameters of constitutional legitimacy: their violation may result in a violation of the Constitution, in particular Article 117, first paragraph. This makes the ECHR a fundamental tool for the protection of fundamental rights, including in constitutional proceedings.
The Firm provides advice on interpretative issues relating to the ECHR and assists clients at every stage of national proceedings in order to enforce the guarantees of the Convention at the domestic level.
It also offers assistance to individuals and legal entities in proceedings before the European Court of Human Rights, drafting the application and representing clients in the proceedings with technical expertise and a focus on the effective protection of rights.
